Abstract

This article examines the interplay between freedom of expression and disinformation in the digital age. Through the analysis of judgments, we seek to understand how the STF has dealt with disinformative speeches, hate speech and the limits to freedom of expression. The rapid dissemination of information and political polarization require a legal doctrine to limit freedom of expression. Document analysis was applied to the jurisprudence of Criminal Action 1044 DF and ADI 7261 MC-REF / DF. It is concluded that freedom of expression, although fundamental, must be exercised responsibly and is not protected when used to spread hate and disinformation.
